Pembina County officials have asked a judge to reconsider his refusal to require another county to help pay for a dam upgrade.
A motion filed by the Pembina County Water Resource Board says state law requires Cavalier County's participation in the Tongue River project and the county should share the cost.
Pembina County officials sought to force Cavalier County to help pay part of a $7 million upgrade of the Renwick Dam on the Tongue River at Icelandic State Park. Cavalier County refused to set up a special assessment district, though it offered to contribute $50,000.
In a ruling earlier this month, Judge Donovan Foughty dismissed Pembina County's lawsuit seeking to force Cavalier County's participation.
The Tongue River drains from Cavalier County through Pembina County into the Red River.
